Terms and Conditions

Thank you for using the DutaMoney service. DutaMoney is an application service as referred to in these Terms and Conditions. When You use the DutaMoney service, You acknowledge and agree that You have carefully read, understand, accept, and agree to all Terms and Conditions that will apply as an agreement between You and PT Duta Teknologi Kreatif, and PT Duta Teknologi Kreatif's partners who are part of this Service.

 

 

PLEASE READ AND UNDERSTAND OUR TERMS AND CONDITIONS CAREFULLY BEFORE DOWNLOADING THE APP OR USING OUR SERVICES FOR THE FIRST TIME.

 

The services available to You on the DutaMoney Application are very diverse, so We must include or enforce additional Terms and Conditions for certain services, where these additional terms are part of our Services and will be subject to and bound by these Terms and Conditions.

 

We reserve the right to, from time to time, make changes, additions, and/or modifications to all or part of the contents of these Terms and Conditions. Therefore, We recommend that You always read these Terms and Conditions so that You can understand each of the provisions that We apply from time to time in these Terms and Conditions.

These Terms and Conditions apply to You as well as to Transactions or to the use of the Service by or through Your Account wherever You are located, whether within the territory of the Republic of Indonesia or in other countries.

If you continue to use the DutaMoney Application after reading these Terms and Conditions (including any changes), you are considered to have agreed to these Terms and Conditions and may use the DutaMoney Application.

  1. Terms and Definition

 

  1.         "Application" refers to this application that you download, which brings you to this Page or these Terms and Conditions, currently known by the brand, name, logo, and/or mark known as "DutaMoney" or any other brand, name, logo, and/or mark.
  1.         Account” or “Your Account” means the unique identification created on DutaMoney based on Your registration request.
  2.         Data” means any data, information, and/or description in any form which from time to time (including when You download the Application) You submit to Us/Service Provider or which You include or submit in, on or through the Application.
  3.         We” or “DTK” refers to PT Duta Teknologi Kreatif.
  4.         "Services" means any services, programs, products, features, systems, facilities, and/or services provided and/or offered in or through the Application.
  5.         Customer Service (DutaMoney Call Center)” is the customer service center function that can be contacted via telephone call and/or email.
  6.         DutaMoney” is an electronic system (platform) created by PT Duta Teknologi Kreatif.
  1.         You” or “DutaMoney User” means the user of the Application.
  1.         “DutaMoney Balance” is the amount of DutaMoney User's electronic money recorded and stored in DutaMoney. The money that is the basis for issuing electronic money will be held in a holding account and can be used by DutaMoney Users to carry out Transactions using DutaMoney.
  1.         Terms and Conditions” means these Terms and Conditions along with any changes, additions, replacements, adjustments and/or modifications made from time to time.
  2.      "Transaction" means any transaction, activity, operation, and/or action carried out in or through the Application, Account, and/or Security Code, including the use of Services or certain features within the Services or Application.
  1.      PT Duta Teknologi Kreatif” is a limited liability company established under the laws of the Republic of Indonesia.
  2.      QRIS” stands for Quick Response Code Indonesian Standard or commonly abbreviated as QRIS (pronounced KRIS), which is the standardization of payments using the QR Code method from Bank Indonesia so that the transaction process with the QR Code becomes easier, faster, and safer.

 

 

  1. Scope

These Terms apply to all users who access and/or use any or all of DutaMoney's electronic money services and related services provided by DutaMoney or through other authorized platforms from some of our partners through which some or all of the features provided by DutaMoney, and therefore any person who submits a request or provides information to us, our affiliates or to Partners related to some or all of DutaMoney's services.

 

  1. Account Registration Mechanism
  1.          You can use the DutaMoney account by making an account usage and/or registration request on any authorized partner application and/or platform. You are required to provide valid, accurate, and up-to-date data and information when you apply for the use of an DutaMoney account.

 

  1.          The opening and registration of the DutaMoney account can only be done by yourself as a legal subject. You represent and warrant that the DutaMoney account registration is only done for your benefit and not for the benefit of any legal entity or business entity. We reserve the right to reject your registration of the DutaMoney account for the benefit of any party other than yourself, including any legal entity and/or business entity.

 

  1. Account Verification
  1.          You may be required to submit additional documents and/or information as we have instructed. This is done only for those of you who wish to use certain services provided to verified DutaMoney users.

 

  1.          We will verify the information and documents that you have provided through our application or Partner application and determine whether you have met the requirements as a verified account user. You hereby agree that we may disclose to and/or collect data and information from our partners who have collaborated with us any and all information and documents in the context of processing account verification.
  2.          Approval and/or rejection of the account usage application and/or registration request is our entire authority with due observance of the applicable laws and regulations.

 

  1. DutaMoney Features
  1.       DutaMoney Balances
  1. DutaMoney balances are not subject to interest calculation, so you will not earn any interest. DutaMoney balance is not a deposit as defined in the Banking Law and will not be guaranteed by the Deposit Insurance Corporation as regulated in the Deposit Insurance Corporation Law.
  2. You can check your DutaMoney balance through the DutaMoney application or its Partners.

 

  1. DutaMoney balance can only be used to make transactions through the DutaMoney application and/or its Partners.
  1.       Top-up and Cash-out
  1. Your DutaMoney electronic money balance can be topped up and cashed out through channels provided by us and/or our Partners, including bank channels. This service may incur certain fees, which may vary depending on the channel used.

 

  1. You understand that top-ups and cash-outs made through Partners or third party channels may experience system and/or network disruptions at any time. Such disruptions are the responsibility of the Partner and/or third party channel and are beyond our control.
  2. The Cash-out feature can only be used by those who have a verified account. Cash-out is intended for withdrawal to a savings account at a bank specified by you.
  1.       Top-up Purchases and Bill Payments
  1. Top-up purchases for telecommunications operators or other operators can be done through DutaMoney and/or Partner applications with the available denominations or as directed in the DutaMoney and/or Partner applications.

 

  1. Postpaid bill payments or monthly bills such as electricity bills, water bills, and other bills can be made through DutaMoney and/or Partner applications.
  1.       Payment Transactions via QRIS Channel
  1.        Types of QRIS used by Dutamoney:

QRIS Merchant Presented Mode (QRIS MPM)

  1. QRIS MPM Static - QRIS image display is displayed in the form of stickers / printouts / digital. The QRIS MPM Static image display can also be sent by the Merchant to the User through digital means to be uploaded on the payment application of the QRIS service providers that implements the QRIS Face-to-Face (TTM) feature.
  2. Dynamic QRIS MPM - QRIS image display is displayed on digital terminal screens (using Electronic Data Capture (EDC) devices, tablets, TVs, computers and others) and non-digital (EDC receipts and others).

 

  1.        Nominal QRIS Transaction

The provisions of Article 8 in the Regulation of Members of the Board of Governors Number 21/18/PADG/2019 dated August 16, 2019 concerning the Implementation of the Quick Response Code National Standard for Payment as amended by the Regulation of Members of the Board of Governors Number 23/8/PADG/2021 dated April 30, 2021 concerning Amendments to the Regulation of Members of the Board of Governors Number 21/18/PADG/2019 concerning the Implementation of the Quick Response Code National Standard for Payment, are amended to read as follows:

 

  1. QRIS Transaction Nominal is limited to a maximum of IDR10,000,000.00 (ten million rupiah) per transaction.
  2. The Issuer may set a daily and/or monthly cumulative nominal limit on QRIS Transactions conducted by each QRIS User.
  3. The cumulative nominal limit as referred to in paragraph (2) is determined in accordance with the regulation of Bank Indonesia's electronic money limit.
  1.        Benefits of Using QRIS for Users:
  1. easy and fast transactions;
  2. convenient, no need to carry physical cash and receive transaction returns;
  3. hygienic;
  4. can get promotional offers from QRIS service providers;
  5. avoid counterfeit money;
  6. keep up with current trends; and
  7. alternative payment method.

 

  1.        Dutamoney QRIS Transaction
  1. Payment transactions through the QRIS channel can be made through the DutaMoney application and / or Partner applications that are linked to Dutamoney electronic money.

 

  1. Dutamoney users can make payment transactions through the QRIS channel at merchants who accept payment transactions through the QRIS channel.
  2. QRIS available at merchants can be scanned by Dutamoney Users through the DutaMoney application and / or Partner applications that have been linked to Dutamoney electronic money to complete transactions at the merchant.
  1.       How to use QRIS safely:
  1.        Pay attention to the QRIS Code Installation Location

When you want to make a payment using QRIS, pay close attention to the location of the QRIS code installation. Make sure that the QRIS that you will use is installed in a legitimate and trusted place. Avoid using QRIS codes that are installed carelessly or suspiciously, such as those in dark or hidden places.

  1.        Check the Conformity of the Code Destination Name with the Merchant on the Screen

After doing a QR scan, carefully check the transaction destination name that appears on your phone screen. Make sure that the destination name matches the actual merchant. If there is a difference between the QRIS code destination name and the merchant, you should be careful because it can be a sign of fraud.

  1.        Double Check Payment Amount Details and Transaction Notifications

Before confirming the payment, double-check the payment amount details shown on your phone screen. Make sure that the amount is as it should be and that there are no suspicious differences. Also, pay attention to the transaction notification that appears after you make a payment. If there is any strange or suspicious information, immediately ask the officer or authorized party before continuing the transaction.

  1.        Don't Share Sensitive Information After QR Scan

When you scan QRIS, make sure not to provide sensitive information to other parties, especially if unreasonably requested. Sensitive information such as PIN or password should always be kept confidential and should not be given to anyone. Fraudsters often use the mode of requesting sensitive information as an attempt to commit further fraud.

  1.        Report to PSP if there is anything suspicious

Report to PJP if Something is SuspiciousIf you find anything suspicious, for example there is a discrepancy between the merchant name and the QRIS destination or there are stacked QRIS codes, immediately report it to the authorized Payment Service Provider (PSP).They will provide necessary assistance and actions to prevent further fraud.Your report can help the authorities to uncover and tackle fraudulent practices related to QRIS.

  1.        Be Careful When Accessing Links from QR Codes

When you want to make a payment using QRIS, pay close attention to the location where the QRIS code is installed. Make sure that the QRIS you will use is installed in a legitimate and trusted place.Avoid using QRIS codes that are installed carelessly or suspiciously, such as those in dark or hidden places.

 

  1. Fees
  1.       In using DutaMoney's electronic money services either on the application or on Partner applications, you may be charged fees, including top-up and withdrawal fees as may be set by us, platform partners or other third parties. We will notify you of any fees that we may charge.
  1.       Other fees charged by third parties directly to you without going through us, such as administrative payment fees for bill payments are the responsibility of third parties and are beyond our control.
  2.       Transaction fee for payment through QRIS channel.

 

Dutamoney users who make payment transactions through the QRIS channel at merchants who accept payment transactions through the QRIS channel will not be charged any transaction fees.

  1. Risk of DutaMoney Electronic Money

You need to understand that any of your login information, including log-in details and PIN when authorizing transactions to your and/or Partner's application is confidential, and therefore you are not allowed to disclose your login details. We and/or our officers and/or our affiliates will never ask for passwords and/or PINs and/or anything related to the authorization process of transactions in any way. You agree to take any risks that occur for the disclosure of such information and be responsible for any consequences.

 

  1. Obligation of Representations and Warranties

 

  1.       You can only access or use the Application, Service, and/or System (a) in accordance with these Terms and Conditions, (b) for legitimate purposes, and (c) not used for fraudulent, illegal, criminal purposes or actions, activities, actions or other purposes that violate or conflict with the law, applicable laws and regulations and the rights or interests of any party. You are solely responsible for checking and ensuring that you have downloaded the correct software for your device. We are not responsible if you do not have a device that is compatible with the System or Application or if you have downloaded the wrong version of software for your device.

 

  1.       You are prohibited from using the Service, Application and/or Account or conducting Transactions: (a) for purposes, activities, activities or actions that violate the law or violate the rights or interests (including Intellectual Property Rights or privacy rights of any party); (b) that have material or elements that are harmful or detrimental to any party; (c) that contain software viruses, worms, trojan horses or other malicious computer code, files, scripts, agents or programs; and (d) that interfere with the integrity or performance of the System and/or Application.

 

  1.       You are prohibited from taking any action including in or through the Application or Account and are prohibited from conducting Transactions that may damage or interfere with Our or Service Provider's reputation.
  2.       You hereby explicitly agree and represent and warrant that:
  1. you are an individual who is legally capable of taking legal action under the laws of the Republic of Indonesia including to bind yourself in these Terms and Conditions. If You do not fulfill these conditions, We reserve the right to activate or terminate the use of the Account, Service and/or Application at any time, either temporarily or permanently;

 

 

  1. You have the right, authority and capacity to use the Service and Account and to carry out all Terms and Conditions;
  2. You have read the entire contents of the Terms and Conditions and have fully understood and comprehended the contents of these Terms and Conditions and therefore voluntarily bind yourself to comply with and implement all of these Terms and Conditions;
  3. You represent and warrant that the funds used for transactions are not derived from criminal activities prohibited by the applicable laws and regulations of the Republic of Indonesia. The opening of this account is not intended and/or aimed at committing money laundering crimes in accordance with the applicable laws and regulations of the Republic of Indonesia. Transactions are not conducted with the purpose of deceiving, obscuring, or avoiding reporting to the Financial Transaction Reports and Analysis Center (PPATK) in accordance with the applicable laws and regulations of the Republic of Indonesia. You are fully responsible and release DutaMoney from any claims, demands, or compensation of any kind if you engage in money laundering crimes based on the applicable laws and regulations of the Republic of Indonesia.
  4. All Data, whether You have provided or submitted or which You will provide or submit directly or indirectly in the future or from time to time, is true, complete, accurate current, and not misleading and does not violate the rights (including but not limited to intellectual property rights) or interests of any party. The Data Submission by You to Us, or on or through the Application or System does not violate applicable law and does not breach any deed, agreement, contract, agreement, or other document to which You are a party or by which You or Your assets are bound;
  5. The Service, Application, and Account will be used for your own interests that you legally represent as referred to in letter c above;
  6. You will not grant any rights, authority, and/or control of attorney in any form and under any circumstances to any other person or party to use the Data, Account and/or PIN, and You for any reason and under any circumstances will not and are prohibited from transferring the Account to any person or party; and
  7. In or during the use of the Service, Application and/or Account, you agree to comply with and carry out all provisions of applicable laws and regulations including laws and regulations in your home country and in the country or city where you are located.
  1.       By executing transactions through DutaMoney Mobile Application, You understand that all communications and instructions from You received by Us will be treated as solid evidence even if they are not made in the form of a written document or issued in the form of a signed document, and, accordingly, You agree to indemnify and hold Us and Our associates harmless from any losses, liabilities, claims and expenses (including litigation costs) that may arise in connection with the execution of Your instructions.

 

  1. Limitation of Liability
  1.       The Services are provided on an “as is” basis. We and the bank (in some features) make no representations or warranties of any kind as to the reliability, security, timeliness, quality, suitability, availability, accuracy, and/or completeness of the Service, Application and/or System. We do not make any representations or warranties of any kind that:
  1. the use of the Services, Application, Account, and/or System (or any part thereof) will be secure, timely, uninterrupted or free from errors, disruptions, viruses, or other obstacles or other harmful components;
  1. The Services, Applications, Accounts, and/or Systems may continue to operate or be used in combination with or with a combination of devices (both hardware and software) or other party systems that we do not provide or own for the operation of the Application;
  2. The provision of the Service or Application or the smooth transaction or use of the Account will fulfill your requirements or expectations;
  3. Any transaction data that we store or stored within the System must be accurate or reliable;
  4. The quality of the Service or Application will fulfill Your requirements or expectations; and
  5. There will be no errors, disruptions, or defects in the System, Service, and/or Application.

Given that Dutamoney only provides a platform for most of the Services provided by the Service Provider, we are not responsible for the content, form, type, and/or availability of these Services or other matters related to these Services which are entirely the responsibility of the Service Provider.

  1.       You acknowledge and agree that We have the right to block and/or close the Account and/or services/facilities if: a.) We understand and have sufficient reason to state that there has been or will be financial or banking or criminal manipulation related to the AmbassadorMoney User Account and/or services/facilities; b.) The holder or customer provides invalid/incomplete data to us; c.) There is a written request from the Police, Prosecutor's Office, Court, Financial Transaction Reports and Analysis Center (PPATK), Tax Office or other authorized institutions in accordance with applicable laws and regulations or to fulfill obligations/debts that have not been settled by the account owner.
  2.       You hereby acknowledge that the Service, Application, Account, and / or System may or may experience, there are or occur restrictions, delays, and / or other problems including those caused by or in connection with (a) unavailability or limited network (including internet network) and / or use or (b) unavailability, disruption, or malfunction of certain features on the device you are using. We are not responsible for any delay, hindrance, unsuccessful, disruption, or failure of a Transaction caused by the above.

 

  1.       You hereby acknowledge that there is a possibility that (a) the System or Application (or any part of the System or Application) is unstable, interrupted, stopped, does not run properly, does not run perfectly and / or has several bugs, and / or (b) the Service (or certain features or parts) may change, be unavailable, and upon the occurrence of this You agree not to submit a Claim to Us.

 

  1.       We are under no circumstances responsible for any Claims from any party including You or for Your losses and any party that occurs as a result of or in connection with:
  1. loss of Data;
  1. loss of income, profits, or other revenue;
  2. loss, damage, or injury arising from, or related to your use of the Application, Service and/or Account or for your inability or error in using the Service, Application and/or Account; or
  3. claims or lawsuits suffered by You that may arise as a result of incomplete submission of information from You or as a result of non-execution of Your instructions, including cancellation, amendment of instructions (for instructions that have not been executed) submitted to Dutamoney, except if the loss occurs as a result of intentional misconduct or negligence by Dutamoney.
  1.       You hereby agree and bind yourself to release Us from all Claims in any form and anywhere in the event that We are unable to execute, continue or carry out Transactions or orders or instructions from You through the Application or Account, either in part or in full, which are caused by events or matters beyond Our control or ability including but not limited to (a) any computer virus interference, (b) trojan horses system, (c) components or systems that can harm and disrupt the Application, Service and/or Account, (d) Internet Service Provider services or services or other third party services available in the Service, and / or (e) natural disasters, war, riots, malfunctioning equipment, systems or transmissions, power failures, telecommunications disruptions, government policies, banking and / or financial system failures and other events or causes beyond Our power or ability.

 

  1.       You hereby agree and bind yourself to release Us from any and all Claims in any form, from any party and wherever submitted, arising, or occurring in connection with or as a result of:

 

  1. the use of Data by Us based on these Terms and Conditions or based on the approval, acknowledgment, authority, control, and/or rights that You provide either directly or indirectly to Us under these Terms and Conditions;
  2. the provision of Data either directly or indirectly by You to Us or within or through this Application which You do in (i) violating or against the law or applicable laws and regulations, (ii) violating the rights (including intellectual property rights) of or belonging to any person or party, or (iii) violating any contract, cooperation, agreement, deed, statement, determination, decision and/or document to which You are a party or to which You or Your assets are bound;
  3. unauthorized use of the Application, Account and/or Service (i), (ii) in violation of applicable law, (iii) in violation of these Terms and Conditions, and/or (iv) for fraudulent, criminal, unauthorized acts or other unlawful acts or purposes.
  1.       You hereby agree and bind yourself to compensate Us for all losses incurred and reimburse all costs, fees, charges, and expenses that We have incurred or may incur or pay in connection with or as a result of the Claim as referred to in points 6, 8, and 9 above (including but not limited to legal fees that we pay or incur to conduct defense or other necessary actions related to the Claim).

 

 

  1.       You hereby agree that We will be exempted from all claims, if We are unable to carry out instructions from You, either partially or entirely caused by events or causes that are beyond Our control or ability, including but not limited to natural disasters, wars, riots, hardware conditions, electronic infrastructure system failures or transmissions, power disruptions, telecommunications disruptions, clearing system failures or other matters determined by Bank Indonesia or other authorized institutions.

 

  1.    After the event that causes Dutamoney and/or its partners to be unable to carry out instructions from the Account Owner ends, Dutamoney and/or its partners will resume the instructions within a period of time in accordance with Bank Indonesia's regulations.

 

 

9.11. As an DutaMoney User, Account owner, You are responsible for always maintaining the confidentiality of Your Account, including but not limited to; the confidentiality of the password You use to login and access Your Account and Our services. Therefore, We are not responsible if, You experience losses caused by Your negligence in maintaining the confidentiality of Your Account, and You hereby release Us, Our directors, board of commissioners, employees, agents, and/or affiliates, from any claims, lawsuits, damages, and/or claims submitted by You in connection with the unauthorized use and/or access to Your Account.

 

  1. Intellectual Property Rights
  1.       The entire System and Application including but not limited to: (a) the layout, design and appearance of the Application contained in or displayed on Your Application media; (b) logos, photos, images, names, brands, words, letters, numbers, writings, and color arrangements contained in the Application; and (c) the combination of the elements referred to in letters (a) and (b), are entirely Our Intellectual Property Rights and no other party has rights to the Application or to the layout, design and appearance of the Application.

 

  1.       You are prohibited to in any way and under any conditions use our Intellectual Property Rights as referred to in point 1 above, without Our prior written consent.

 

  1. DutaMoney Electronic Money Value Limits
  1.       The limit of the value of electronic money that can be stored in electronic money is determined:
  1. for unregistered electronic money at a maximum of Rp2,000,000.00 (two million rupiah); and
  1. for registered electronic money at a maximum of Rp20,000,000.00 (twenty million rupiah).
  1.       The limit of electronic money transaction value in 1 (one) month is determined:
  1. for unregistered electronic money at a maximum of Rp20,000,000.00 (twenty million rupiah); and
  1. for registered electronic money at a maximum of Rp40,000,000.00 (forty million rupiah).

The limit on the value of electronic money transactions is calculated from incoming transactions.

 

  1. Term and Termination
  1.       This Terms and Conditions is effective as long as you have not closed your Account and electronic money on the DutaMoney Service.

 

  1.       We reserve the rights to (i) not carry out orders from You, (ii) not continuing or not forwarding or limiting Transactions, (iii) stop, suspend or disable the use of the Account, Service or Application, (iv) freeze partially or entirely the DutaMoney Balance, and/or (iv) stop or suspend Your membership as an Application user, where for each of the aforementioned conditions either temporarily, for a certain period of time or permanently based on Our considerations or decisions that We consider good, if one or more of the conditions below occur:

 

  1. based on Our own assessment, decision, and/or consideration, We know or suspect that there has been or will be or use of the Account, Security Code, Application, and/or Service for fraudulent purposes, criminal purposes, criminal acts, and/or for other purposes, reasons, actions, or activities that violate the laws or regulations of the Republic of Indonesia and other countries;
  1. based on Our own judgment, decision, and/or consideration (a) We know or suspect that an improper Transaction has occurred, and/or (b) the number of Transactions using or through the Account and/or Security Code in one day exceeds the amount or level of reasonableness of the Transaction, each as determined by Us;
  2. based on Our own judgment, decision, and/or consideration, You have violated one or more of the Dutamoney’s Terms and Conditions and/or terms and conditions of DTK affiliates or partners that have the potential to harm DTK, its affiliates and/or partners either directly or indirectly;
  1. based on orders from regulators or competent authorities;
    1. official requests from DutaMoney Users via the official complaint line on the Application and/or contact details on DTK Contact (“Help”)
    2. some or all of the Data is invalid, incomplete, false, fictitious, and/or misleading;
    3. the email address or telephone that You include or use for the use of the Application or Service or to make Transactions has been blocked;
    4. You have not completed the process or requirements as stated in the applicable laws and/or regulations;
    5. We are conducting updates, maintenance, changes, upgrades, adjustments, replacements, and/or other actions on the Application, Service and/or System (or any part thereof) and for that We are not obliged to be responsible to anyone; and/or
    6. You pass away.

 

  1.         In the event that a DutaMoney User passed away, the family/heirs who wish to apply for Account closure are required to submit the following documents via the Help line:
  1. photocopy of DutaMoney User's Death Certificate;
  1. photocopy of DutaMoney User's identity card;
  1. photocopy of DutaMoney User's family card;
  1. photocopy of family/heir identity card who requests Account closure;
  1. photocopy of family card of the family/heir requesting account closure; and
  1. photocopy of heir information that has been legalized by the sub-district and sub-district.

 

  1.         In connection with the provisions stipulated in paragraph 3 above, DTK will only close the Account and return the DutaMoney Balance after all the above required documents have been declared complete by DTK. Refunds of DutaMoney Balance will be made no later than 30 (thirty) Business Days after the Account is closed. The amount of DutaMoney Balance returned will be reduced by outstanding fees or other obligations, unless based on DTK's consideration, it is necessary to withhold certain portions of the DutaMoney Balance in connection with indications and/or suspicions of Suspicious Transactions. In connection with the detention of part of the DutaMoney Balance, the DutaMoney User authorizes DTK with the right of substitution and cannot be revoked to hold part of the DutaMoney Balance without prior notification to the DutaMoney User. To avoid doubt, the minimum return of DutaMoney Balance that can be made by DTK is IDR 10,000 (ten thousand Rupiah).
  1.         DutaMoney users hereby declare that they will release DTK from all forms of losses, claims, expenses, damages, obligations to pay fees, and/or lawsuits in any form in connection with the closure of the Account and the return of the Dutamoney Balance, including those submitted by the heirs, executors, management or any third party representing DutaMoney Users.
  1.       In the event that the Account is closed and the Dutamoney Balance is returned as referred to in the previous paragraphs above, the Dutamoney User is obliged to complete all DutaMoney User obligations to DTK, its affiliates and/or partners that arose and existed before the Account was closed. DutaMoney Users agree that these Terms and Conditions will remain in effect until all DutaMoney User obligations have been fulfilled.
  1.       You hereby agree to waive the provisions of Article 1266 paragraph (2) and (3) of the Civil Code so that the Terms and Conditions, Application and/or Service can be terminated (either partially or entirely, either temporarily or permanently) in accordance with the Terms and Conditions without the need for a decision or determination from a court judge.
  2.       You agree and bind yourself not to take any action that can limit, inhibit, and/or reduce one or more of Our rights and/or authorities under these Terms and Conditions and applicable law.
  1.         Restricting access, suspending Services and/or closing Accounts temporarily or permanently does not limit DTK's right to demand compensation, report DutaMoney Users to the authorities, and/or take other actions that DTK deems necessary to protect DTK's interests.

 

  1. Governing Law and Dispute Resolution
  1.       These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia.

 

  1.       Any dispute or controversy arising in connection with or relating to the matters set out in these Terms and Conditions (or any part thereof) including disputes caused by the existence or commission of a tort or breach of one or more of these Terms and Conditions (“Dispute”) shall be resolved in the following method
  1. neither party, You or Us (“First Party”) must submit written notice to the other party (“Second Party”) regarding the occurrence of a Dispute (“Dispute Notice”). The Dispute must be resolved by deliberation within 90 (ninety) calendar days from the date of the Dispute Notification (“Deliberation Resolution Period”);
  1. if the Dispute cannot be resolved by deliberation until the expiration of the Deliberation Settlement Period, the First Party and the Second Party must jointly appoint a third party (“Mediator”) as a mediator to resolve the Dispute and such appointment must be set forth in a written form jointly signed by the First Party and the Second Party;
  2. You are obliged to bear all costs, fees, and expenses that We have incurred or may incur in the context of resolving the Dispute (including but not limited to the costs, fees, and expenses for attending the arbitration hearing and for preparing and submitting all defenses, lawsuits, claims, information, evidence, information, and/or any documents in the context of conducting or during the arbitration hearing process) until there is a final and binding arbitration award;
  1. unless required under the applicable law or requested based on an official request, decision, or determination issued, made, or rendered by a court or authorized government agency, during the process of resolving the Dispute as stipulated above until there is a legal, final and binding decision of the First Party and the Second Party, the First Party and the Second Party are obliged to keep confidential all information related to the Dispute and the settlement process and are therefore prohibited from in any way informing, notifying or announcing to any party the existence of the Dispute or the settlement process including but not limited to through mass media (newspapers, television or other media) and/or social media. If You violate the provisions of this point (f), You hereby acknowledge and agree that all or part of Your right to use the Service, Application, Account and/or PIN may at any time be terminated or deactivated by Us either temporarily or permanently.

 

  1. Force Majeure

We acknowledge the possibility that we may be unable to execute, continue, or carry out transactions or instructions from you through the DutaMoney application or via Partners, whether partially or entirely, due to events or circumstances beyond our control or capabilities, including but not limited to:

  1. Any disruption from computer viruses;
  2. Services or services from Internet Service Providers or other third-party services available in the Services; and/or
  3. Natural disasters, war, riots, malfunctioning equipment, systems or transmissions, power outages, telecommunications disruptions, government policies, banking and/or financial system failures, and other events or causes beyond our control or capabilities. You hereby agree that we will be exempt from any claims if we are unable to execute your instructions, whether partially or entirely, due to such events or causes of Force Majeure.

 

  1. Amendments

We have the rights to, from time to time, make changes, additions, and/or modifications to all or part of the contents of these Terms and Conditions by announcing them to you, among others, through the DutaMoney application and/or Partners. You understand and agree that if You use the services of the DutaMoney application and/or DutaMoney services at Partners on a continuous and ongoing basis after changes, additions and/or modifications to all or part of the contents of the Terms and Conditions constitute Your consent to such changes, additions and/or modifications. If You do not agree to such changes, additions and/or modifications, You are requested to stop accessing and/or using the DutaMoney Services.

  1. Miscellaneous Provisions
  1.       All agreements, control, authorities and/or rights that You give Us in these Terms and Conditions cannot end for any reason including for reasons referred to in Articles 1813, 1814, and 1816 of the Civil Code as long as You are still using the Service or Application or still using and/or having an Account.
  2.       You hereby release Us from all Claims in connection with the implementation of all Our actions based on the control, authority and/or rights that You give Us in or based on the Terms and Conditions as well as the implementation of Our rights or authorities under the Terms and Conditions.
